California is adoption Friendly.  September - 2002 Governor Gray Davis signed
Assembly Bill 746, permitting non-residents to have access to the adoption courts
of the state of California.  

Non-residents who enter into an adoption plan with birth parents who reside in
California may finalize their adoptions in California under this law.  The adoptive
parents do not need to own or rent in California. Adoptive parents may now come
to the state solely to receive custody of the child.

The California laws can also be helpful where an alleged birth father may have
greater rights in a state other than California.  California laws concerning birth
fathers tend to favor the adoptive parents if the birth father has not been
meaningfully involved and financially supportive of the birth mother and the
pregnancy.  

California birth parent residency requirements state the birth parent must be a
resident of the state at the time the baby is born or is relinquished to a Licensed
California State adoption agency, or when the birth parents sign consent to adopt.

Adoptive parents living outside of California would then petition to finalize their
adoption in California, generally through the California attorney representing
them in the adoption process.  A benefit is, the adoptive parents do not then have
to re-finalize in their home state once the adoption is finalized in California.

Approval of a home study that meets the California Department of Social Services,
which defines and regulates the content of acceptable home studies, is a
requirement that must be discussed with your California attorney before pursuing
to adopt in California.  

California law currently requires the adoptive parents to return to California with
the child who is the subject of the adoption petition, for the finalization of the
adoption, and appear before a judge in a court approximately 180 days after the
placement of the child into their custody for the purpose of adoption.
